  • We use recordings of training or demo sessions with Attendees for quality assurance, audit control, training with the Attendees and/or their representative, and internal training purposes to improve current and future training and/or content services.   • We use the Personal Information of Clients or Account Holders to verify your identity; manage our relationship with you (e.g., registering your account; notifying you about changes to this Policy, asking you to leave a review or take a survey); and/or perform a contract we have with you, including to provide Services you have subscribed for. Client payment card information is used to manage payment, fees and charges and collect and recover money owed to us. Contact information may be used to send you general (non-marketing) commercial communications including relating to safety training you have subscribed to receive from us.
  • The information that we collect automatically from Website Visitors is used to provide and administer the Website and the Services and manage internal operations, including for troubleshooting, data analysis, testing, research, statistical and survey purposes, and to develop the Website and the Services to improve your experience. Definitions

In this Policy, the following terms have these meanings:

  • Account Holder” means an individual who has created an account (including a corporate or learner account) on the Website.
  • Attendee” means an individual who attends one of our training sessions.
  • BIS” means Business Improvement Solutions Inc.
  • Client” means an individual with whom the Company has a direct business relationship and to whom we provide Services.
  • Contact” means an individual who contacts us for any purpose, including through the use of the “Contact” feature on the Website, by email, by telephone or otherwise.
  • Personal Information” means information about an individual. It does not include information that is publicly available or business contact information, each as defined by applicable laws.
  • Services” means providing access to safety training video content through a reseller’s portal.
  • Subscriber” means an individual who opts-in to receive our marketing communications, such as our e-newsletter.

  • Website Visitor” means an individual who accesses or uses our Website.

What Personal Information Do We Collect and How?

The type(s) of Personal Information that we collect from or about you, and the manner in which we collect or access such Personal Information, depend on the nature of your relationship with us.

In most cases, we collect Personal Information directly from you.  For example, you may provide your Personal Information directly to us when you request the Services or assistance from us, become a Subscriber, or contact us with a question, comment or concern.

As described in greater detail below, we may also collect Personal Information about you using technology. For example, we may collect Personal Information about Website Visitors using cookies, web beacons and other tracking technologies. We may also record training sessions using the record feature on the videoconferencing platforms where we host training sessions.

In the event that you submit or make available Personal Information about another individual to the Company, you represent and warrant that you have obtained their lawful consent to submit or make available their Personal Information on their behalf.

Attendees

If you attend a training or demo session that we host on a videoconferencing platform, we may record such sessions for quality assurance and internal training purposes. In such a case, we may collect your image/video likeness and any Personal Information shared during the session. If you do not agree to our collection of your image/video likeness, you may turn off your webcam or ask that your session not be recorded.

Clients / Account Holders

We collect Personal Information from our Clients and/or Account Holders in order to provide the Services to them. This Personal Information is generally submitted directly by you, and may include your name, profile name, email address, phone number, address, city, province/state, postal/zip code, business name, business address, industry, and profile photo or avatar.

If you subscribe for the Services, you may be required to provide your payment card details. All online card transactions for BIS products are processed by BIS. You should only provide your Personal Information to BIS after reviewing and confirming that you agree with the processing of your Personal Information as described in BIS’s Privacy Policy. We do not retain any record of your payment card information, unless you are purchasing a custom (i.e. non-BIS) product directly from us. We use your payment card information solely to process payments you make to us and for fraud prevention and detection purposes.

Website Visitors

We and/or our service providers collect information from or about Website Visitors through the use of cookies, web beacons and other similar tracking technologies. A cookie is a small computer file or piece of information that may be stored in your device’s hard drive when you visit our Website. We may use information collected using cookies to improve our Website’s functionality and, in some cases, to provide visitors with a customized online experience.

These cookies are essential to enable you to move around the Website and provide the Services. Essential cookies do not gather any information that could be used by us for marketing purposes. Users of the BIS Platform

We may have access to additional Personal Information as “master administrator” on the BIS platform, at the discretion of each company administrator and/or designated representative. This Personal Information may include:

  • Telephone or Mobile phone number;
  • Profile name, image or avatar;
  • Employee ID number;
  • Employee Department, Job Title, or Worksite location;
  • City, Province/State, Country, and Postal Code/Zip Code; and
  • Any other Personal Information submitted to, or contained in accessible records on the BIS platform.

How Do We Use Personal Information?

The purpose(s) for which we use your Personal Information also depend on the nature of your relationship with us.

Clients / Account Holders

Information collected from or about our Clients may be used to verify your identity; manage our relationship with you (e.g., registering your account; internal accounting and administration; notifying you about changes to this Policy, asking you to leave a review or take a survey); and perform a contract we may have with you, including to provide the Services you have subscribed to (e.g., to allow you to access or view content on the Website), to provide customer service, to answer your questions and to respond to your requests. Users of the BIS Platform

Where we have been given access to additional Personal Information on the BIS platform, we will only use this information in order to fulfill our contractual obligations to Business Information Solutions (BIS) and to fulfill service delivery to you, your Employer or designated representative.

Service Providers

There are certain services supplied to us by third parties.  Currently, the types of service providers engaged by the Company who may have access to or handle Personal Information on our behalf are:

  • Companies that maintain, host or otherwise provide services related to our Website, who may have access to Website Visitors’ and Subscribers’ Personal Information in order to perform these functions. This includes:
    • Google reCAPTCHA, which we use on the Website to distinguish between individual Website Visitors and automated systems, for fraud detection and security Personal Information collected by reCAPTCHA is governed by Google’s privacy policy and terms of service; and
    • Hostgator, located in Houston, Texas, United States of America, who may have access to personal information, which they are permitted to use for the purpose of in accordance with the terms of their Privacy Policy;
    • Our tech support service providers (including Soapbox Studios, Hostgator for the Website, and BIS for the BIS platform) may use remote access in the course of providing you with tech support. In such instances, they may collect, use and/or disclose Personal Information, which practices are governed by their respective privacy policies.
  • Companies that provide services related to the sending of electronic mail, such as email hosts, who may have access to and handle Subscribers’ Personal Information for the purpose of sending marketing communications, surveys, or other communications;
  • Companies that provide us with or maintain our databases and servers, including cloud services providers such as Amazon Web Services, and customer relationship management services, who may have access to or handle any Personal Information stored in such databases or servers for the purposes of providing their respective services;
  • Payment processors who may have access to payment information in order to process payments;
  • Companies that assist us in serving advertisements, conducting contests or surveys, or performing analysis of our Services, customer demographics, and public sentiment, who may have access to Website Visitor’ Personal Information in order to perform these functions;
  • Companies that assist us in managing our security, risk management, and compliance objectives, including data security providers and other advisors, in order to perform these functions; and
  • Vimeo, which we use as a video hosting platform. Vimeo may collect Personal Information of visitors to the platform, which it handles in accordance with its privacy policy.

Our service providers may collect, use, disclose, store or otherwise handle Personal Information outside of Canada, including in the United States and countries listed in our service providers and third party service provider’s privacy policy and terms and conditions.

Please note that we may change or add third party service providers at any time, in our sole discretion, either in Canada or elsewhere. We encourage you to review our Policy from time-to-time to obtain updated information about our service providers.

Social Media Integrations

Our websites and mobile applications may use social media features and widgets (“SMI”). These are provided and operated by third-party social media companies (e.g., Facebook, Instagram, LinkedIn) and either hosted by a third party or hosted directly on our website or mobile application. SMI may collect information such as the page you are visiting on our website/mobile application and your IP address.

Suppose you are logged into your account with a third-party company. In that case, the third party can link information about your visit to, and use of our website or mobile application to your social media account with them.

Similarly, the third party may record your interactions with the SMI Features and send us information in line with their policies, such as your name, profile picture, gender, friend lists, and any other information you have chosen to make available. We may share information with the third-party company to serve targeted marketing to you via the third-party social media platform. You can manage sharing information and opt-out from targeted marketing via your privacy settings for the third-party social media platform.

Your interactions with these SMIs are governed by the privacy policy of the third-party company providing them. Business Transactions

In accordance with applicable laws, we may disclose your Personal Information to third parties in connection with financing that we seek or in connection with a prospective or completed business transaction, including a merger, sale or transfer involving all or part of the Company or as part of a corporate reorganization or other change in legal form or corporate control.

Legal & Compliance

There are circumstances where we may disclose or otherwise handle Personal Information without your knowledge, notice or consent, when required by law or lawful authority. For example, from time to time, we may be compelled by law to release information in connection with statutory reporting obligations, search warrants, court orders or bankruptcy or insolvency proceedings.

In certain circumstances, we may also be permitted by law to disclose or otherwise handle Personal Information without the knowledge or consent of the individual concerned. For example, we may disclose Personal Information without consent to investigate a potential breach of law or contract, to collect on a debt, or in certain emergency situations that threaten the life, health or security of an individual.

International Transfers of Personal Information

We may transfer or store your Personal Information outside of Canada, including to or in the United States. Personal Information transferred or stored outside of Canada will be subject to the laws of the jurisdiction(s) where it is transferred or stored, and may be accessible to foreign courts, law enforcement and national security authorities in the jurisdiction(s) where it is transferred or stored.

Quebec Privacy Notice

Your Personal Information may be accessed by or disclosed to employees of the Company who have a need to know such information. Such employees may include the Managing Director, HR Advisor, HR Generalist, Learning and Development Specialist, IT Helpdesk, Network Administrator, Social Media and Communications Specialists and those within Corporate and or Shared Services depending upon the information they each require in order to perform their job duties and responsibilities.

We will store your Personal Information in Canada, including at our offices in British Columbia, and on third-party data servers (including servers hosted by AWS Canada). In addition, we may transfer or store your Personal Information outside of Quebec or Canada as laid out at “International Transfers of Personal Information” above.

How Do We Protect Personal Information?

The Company has implemented reasonable administrative, organizational, technical and physical measures in an effort to safeguard the Personal Information in our custody and control against theft, loss and unauthorized access, use, modification and disclosure.

Examples of the measures we currently use to protect Personal Information include, but are not limited to encryption, email filters, data retention policies, and confidentiality agreements with third parties.

Despite our implementation of these measures, posting or transmitting information via the Internet, including the Website, by email or by other electronic means, is not completely secure. Although we take steps to protect your Personal Information, we cannot guarantee that Personal Information that is handled by or transmitted to us, particularly by electronic means, will be completely secure.  It is possible that third parties may unlawfully intercept or access such information.

We make every effort to maintain the accuracy and completeness of your personal information, which we store, and to ensure that all of your personal information is up to date. However, you can assist us considerably by promptly contacting us if there are any changes to your personal information or if you become aware that we have inaccurate personal data relating to you. You should immediately inform us if you become aware that your personal information has been provided to us by another person without your consent or if you did not obtain permission before giving another person’s personal information to us.

Retention of Personal Information

We generally retain Personal Information for only as long as it is needed to accomplish the purpose(s) for which it was collected, or as needed for authorized, legitimate or legal purposes, in accordance with applicable laws.  When Personal Information is no longer necessary or relevant for these purposes, we will take steps to have it deleted, destroyed, erased, aggregated or made anonymous, in accordance with applicable laws.

 The criteria used to determine our retention periods include the following:

  • The length of time we have an ongoing relationship with you and provide Services to you (for example, for as long as you have an account with us or keep using our Services);
  • Whether account owners modify or their users delete information through their accounts;
  • Whether we have a legal obligation to keep the data (for example, specific laws require us to maintain records of your transactions for a certain period before we can delete them); or
  • Whether retention is advisable in light of our legal position (regarding the enforcement of our agreements, the resolution of disputes, and applicable statutes of limitations, litigation, or regulatory investigation).

You may request access to your Personal Information that is in the possession of the Company. However, access may be declined where permitted or required by applicable laws. The linked websites have separate and independent privacy statements, notices and terms of use, which we recommend you read carefully before using such websites and making your Personal Information available to their operators.  We do not have any control over such websites, and therefore we have no responsibility or liability for the manner in which the organizations that operate such linked websites may collect, use or share, secure and otherwise handle your Personal Information. Age Restrictions

Our Services are available for purchase only for those over 18. Our Services are not targeted to, intended to be consumed by, or designed to entice individuals under 18.
